The Website is owned,managed, and operated by Created Gems, a partnership firm (hereinafter referred to as "Created Gems", "we", "us", or "our") with its principal office at K1/48, Lower Ground Floor, Chittaranjan Park, New Delhi, India-110019. The Website functions as an e-commerce platform that allows users to browse, select, and purchase lab-grown diamond jewellery, moissanite, precious stones, precious metal jewellery, and related accessories (collectively, the "Products" or "Goods"). By accessing, browsing, visiting, or otherwise using the Website, you (the "User", "Customer", or "you") acknowledge that you have read, completely understood, and agree to be strictly bound by these Terms and Conditions (the "Terms"). These Terms constitute a legally binding agreement between you and Created Gems. You further agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our service, including but not limited to copyright and trademark laws. If you do not agree to be bound by these Terms in their entirety, you must immediately cease all access to and use of the Website.

All content, features, and functionality present on the Website including but not limited to text, graphics, logos (including all variations of the Diamos logo), images, videos, audio clips, product descriptions, jewellery designs, digital downloads, software, and the overall website design and layout (trade dress) are the exclusive property of Created Gems, its licensors, or other material providers.  This material is strictly protected under Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.  You are expressly prohibited from copying, reproducing, modifying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works from, or exploiting any content from the Website for any commercial, public, or unauthorized purpose whatsoever without the express, prior written consent of a partner of Created Gems.

Created Gems makes every reasonable effort to display the Products listed for sale on the Website as accurately as possible. However, the actual colours, dimensions, and details you see will depend on your specific computer monitor, device screen, and display settings. Therefore, we cannot guarantee that your device's display of any color, texture, or detail will strictly match the physical Product. Further more, Created Gems does not warrant that product descriptions, images, or other content on the Website are entirely accurate, complete, reliable, current, or error-free.

While Created Gems strives to ensure that all Products are described and priced accurately, typographical, computational, or system errors may occasionally occur. In the event a Product is listed at an incorrect price or with incorrect information, Created Gems reserves the right, at our sole discretion, to refuse or cancel any orders placed for that Product, regardless of whether the order has been confirmed. If your order is cancelled after your payment has been processed, Created Gems will promptly issue a full refund to your original method of payment for the transaction amount.

Due to the intricate manufacturing process of fine jewellery, including pieces featuring lab-grown diamonds and various precious metals, slight variations in the final weight of the Product may occur. The gold or precious metal weight displayed on the Website for any given Product is an approximation. In the event of a material variation between the stated weight and the final manufactured weight (due to an excess or lesser amount of precious metal used), a differential amount may be charged or refunded to the Customer. Any differential rate shall be calculated strictly based on the prevailing market rate of the specific precious metal on the date the order was originally placed. For the same, we will send you an additional invoice before shipping the order to your location.

All orders placed through the Website are subject to Product availability and formal acceptance by Created Gems. Please note that the receipt of an automated electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Created Gems reserves the right at any time after receipt of your order to accept, decline, or limit your order for any reason, at our sole discretion. If a Product becomes unavailable after an order has been placed,we will notify you promptly and issue a full refund for the unavailable item or have it custom made for you.

We reserve the right to refuse or cancel any order for any reason, including but not limited to: limitations on quantities available for purchase; inaccuracies or errors in product, manufacturing, or pricing information; or issues identified by our payment processing and fraud avoidance partners. We additionally reserve the right to limit the quantity of items purchased per person, per household, or per order. Furthermore, Created Gems may require additional verifications or information from the Customer before formally accepting any high-value order. Also, please note that for any order exceeding Rs. 2,00,000/- (Two Lakh Indian Rupees Only) we will require Pan Card from your end. Created Gems team may contact you for the same after order confirmation.

Any discounts, sales, or promotional offers displayed on the Website or product pages are subject to specific, accompanying terms and conditions. Created Gems reserves the right to modify, suspend, or terminate any offer at any time, at our sole discretion, and without prior notice. Unless explicitly stated otherwise in writing, promotional offers are valid only while supplies last, hold no cash value, and cannot be combined with other discounts, coupons, or promotions

Created Gems grants you a limited, non-exclusive, non-transferable, and freely revocable license to access and use the Website strictly for your personal, non-commercial use as a visitor or online shopper. Any use of the Website or its contents for purposes other than personal, non-commercial shopping is expressly prohibited.

Created Gems reserves the right to terminate your license and block your access to the Website immediately, without prior notice, at our sole discretion, if we determine you are in violation of these Terms.

Access to and use of the Website is strictly limited to individuals who are legally capable of forming binding contracts under the Indian Contract Act, 1872, and any other applicable jurisdictional laws. Persons deemed "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including but not limited to minors, un-discharged insolvents, and individuals of unsound mind, are expressly prohibited from using the Website independently. Please note that opting out of marketing communications will not affect your receipt of necessary transactional communications.

The purchase and shipment of Products through the Website are currently restricted exclusively to addresses within the Republic of India. Created Gems does not offer international shipping at this time. We reserve the right to immediately cancel and fully refund any orders placed with a delivery address located outside the recognized territory of India. While Created Gems endeavours to process, dispatch, and deliver all orders within the estimated timeframes provided on the Website or at checkout, please be advised that these dates are strictly estimates and are not legally binding guarantees. Created Gems shall not be held liable for any direct, indirect, incidental, or consequential loss, damage, or expense resulting from any delay in delivery. This includes, but is not limited to, delays caused by third-party courier handling, logistical bottlenecks, or Force Majeure events (such as severe weather, natural disasters, strikes, or governmental actions). The terms, conditions, and procedures outlined in that Shipping Policy are hereby incorporated by reference and form a part of these legally binding Terms.

Created Gems offers returns, refunds, and exchanges solely in accordance with the strict guidelines outlined in our dedicated Return Policy. The terms, conditions, timelines, and procedures detailed within that Return Policy are hereby incorporated by reference and form an integral, legally binding part of these Terms and Conditions. By making a purchase on the Website, you explicitly acknowledge that you have read, understood, and agree to be bound by the Return Policy. All Products authorized for a return or exchange must be returned in their original, unworn, pristine condition, complete with all original packaging, diamond certificates, tags, and documentation. Created Gems reserves the right, at our sole and absolute discretion, to inspect any returned Goods and to refuse any return, refund, or exchange if the item shows signs of wear, alteration, damage, or if it has been resized or modified by any third-party jeweller. Also, all sales of custom-made, bespoke, personalized, or engraved jewellery are considered final sale. These specific items are entirely exempt from standard return, refund, or exchange eligibility due to their customized nature.

The Website, including all content, software, functions, materials, and information made available on or accessed through the Website, is provided on an "as is" and "as available" basis. To the fullest extent permissible by applicable law, Created Gems makes no representations or warranties of any kind, either express or implied, regarding the operation of the Website or the information, content, materials, or products included on it. Furthermore, please note that natural tarnishing, fading of metal plating (such as rhodium), and general wear and tear over time are normal characteristics of fine jewellery and do not constitute a manufacturing defect or grounds for a refund.

All prices displayed on the Website are in Indian Rupees (INR) and are strictly exclusive of applicable Goods and Services Tax (GST) and any other statutory taxes or duties. The final price including the applicable GST, any relevant shipping charges, and other associated fees will be dynamically calculated and added to your total order value at the checkout page prior to final payment confirmation. By proceeding with the transaction, you acknowledge and agree that you are solely responsible for the payment of all such applicable taxes and charges associated with your purchase.

Furthermore, you explicitly agree that any legal action, dispute, or proceeding arising out of or relating to these Terms, your use of the Website, or any purchases made hereunder shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India, and you hereby irrevocably consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.

An order shall only be deemed formally placed, accepted, and queued for processing once the full and final payment has been successfully authorized, transferred, and credited to the official accounts of Created Gems. We strictly disclaim any and all liability for financial losses, delays, or damages incurred during the payment process due to circumstances where the funds have not successfully reached us. This includes, but is not limited to, technical malfunctions, bank server downtime, payment aggregator or gateway failures, network interruptions, fraudulent interceptions, or user errors such as entering incorrect transaction details. In the event that a payment is deducted from your account but fails to reach Created Gems due to any such third-party or technical fault, the order will remain unconfirmed, and you must resolve the issue directly with your respective bank, credit card company, or financial institution.

The issuance of any Coupon is strictly a revocable privilege granted by Created Gems and does not constitute a legal right or financial claim against the firm. Purchases, bespoke custom orders, or services conducted in person at our physical retail showroom are governed by a separate, distinct set of return, refund, and exchange policies. In strict accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and all applicable rules made thereunder, Created Gems has implemented a dedicated grievance redressal mechanism. If you have any grievances, complaints, or concerns regarding the Website, our products, your privacy, or these Terms and Conditions, you may formally contact our designated Grievance Officer, Devamshu Behl, at the Created Gems registered office located at K1/48, Lower Ground Floor, Chittaranjan Park, New Delhi 110019. The Grievance Officer may also be reached directly via email at devamshu@diamos.in.We shall acknowledge the receipt of any consumer complaint within forty-eight (48) hours of receipt and shall endeavor to amicably resolve the grievance within one (1) month from the date of initial receipt, in compliance with statutory requirements.
